Restrictive Covenants – Continuing Developments

What do Minnesota, North Dakota and Oklahoma have in common with California? It’s not fish tacos. It’s a near or total ban on restrictive covenants. Starting in January 2023 when the FTC proposed a ban to restrictive covenants, states have taken action at the state level imposing their own limitations. The trend has continued outside the United States as well, and could have implications for M&A.
